Unforgivable Behaviour. Proof for all of the following statements.
- Using art & designs without permission from the original artists for commercial purposes which violates several artist's TOS. (used their artwork for a "fantribe" and profited off of it through myo and design sales)
- Copying the Nel'oth species design to making off-brand Nel'oth designs called "Snakehorns" which look nothing like a snake, nor have horns.
- Intent to buy, void, then resell Nel'oth designs as the off-brand species without changing the design.
- Violating Nel'oth TOS that was agreed to when obtaining and owning a Nel'oth by refusing to redesign voided Nel'oths into something that does not resemble a Nel'oth.
- Threatened to un-credit artists that wanted their art to be removed. Proceeded to re-uploading art and characters with no credit & removing artist's watermark/signature.

GREY LIST

I prefer to no longer have any contact with these individuals.
They are not allowed to commission me.
They are allowed to keep art attached to designs they've obtained.
They are not allowed to obtain my designs in the future if they haven't already had them before being greylisted.
They are not allowed to obtain more Nel'oths.

As a semi permanent GA (guest artist) for my Nel'oth species, they were fine at first but then began to take payments for mystery adopts (and I believe customs) that they never fully delivered.

NFT or Cryptocurrency is not allowed.✦ I do not have, nor plan to use permanent storage for art files but I do keep them for at least 2 months. It is your responsibility to save any files you want to keep.

Terms of Use: Artwork

✦ You may not claim my work as your own.
✦ Do NOT edit/modify my work without my permission! You must ask me if you would like to make minor edits.
Removing my watermark/signature will result in a blacklist.✦ You may use it for personal use, only if the image belongs to you! (ex: profile picture, profile decoration, wallpaper, etc.)
✦ You may display my artwork/designs that belong to you as long as I am visibly credited and linked back to me.
✦ You may print or make a physical reproduction of the artwork as long as it is for your personal use only and NOT for sale.✦ Art commissioned from me may only add its paid-for value to a character’s overall value.
✦ Artwork that I have made for free or traded for has no monetary value but can still add some value to the character overall.✦ I reserve the right that at any time I can request you remove my art from a character that belongs to you.
✦ I reserve the right that at any time I can request you take down a post with my art on it.
✦ I reserve the right that at any time I can demand you remove my art that is being monetized or used for commercial/advertising purposes if there is no agreement between me the offending party.✦ You may reupload artwork obtained from me as long as you inform/ask me first and it is linked back to me!
✦ Uploading artwork to Toyhouse to the correct character(s) is 100% allowed.COMMERCIAL USE:
✦ You may not use any of my work for commercial or non-commercial purposes, or redistribute, nor replicate my work without my permission. As in pieces created by me; commissioned, gifted, or otherwise, is for personal enjoyment only unless previously discussed and an agreement was reached.
(ex: used in advertisement, posters, apparel, mugs)
✦ Please contact me if you would like to use my work for commercial purposes.

Terms of Use: Design

✦ You may not claim to be the designer and I must be credited for the designs I create (or species if applicable).
Removing me as the designer (or creator if applicable) will get you blacklisted.
✦ Owners of my designs must give proper credit when sharing.

✦ The owner of the design created by me may use said design as an avatar, sona. etc.✦ I am 18+, therefore NSFW art of my designs are 100% okay as long as it isn't feral or underage nsfw. Violation of this will get you blacklisted.
✦ Sexualizing/P*rn of my feral designs is prohibited.✦ I will not resell the rights to a design once ownership is transferred to you, the Client.Rehoming Designs:
✦ Do not resell my designs at a higher price without added personal or commissioned art.
Art obtained for FREE has no monetary value but can still add some value to the character overall. _{Do not abuse this and inflate the value beyond reason.}
(Original price + commissioned artwork + value of your own artwork)
✦ Designs that were originally obtained through a TRADE with me can be resold. The base monetary value is determined by me based on how much I value the design.
✦ Designs that were originally made for FREE (such as a raffle/gift/DTA design, or for charity) will not be able to be resold, but can be regifted. It can also be traded only if it has additional artwork. (unless specified otherwise)
✦ Give-a-way/Gift/Trading is okay! (unless specified otherwise)
My designs do not loose their original monetary value if traded or gifted!Redesigns:
✦ Feel free to change or alter the design to your liking. You may also change the species.
✦ Redesigns for designs made by me that currently belong to a closed/semi/open species must follow that species' design rules.
↳ If you are redesigning or adapting my design to be part of a species, you should know what the design rules are and adhere to them.Original Species & Concepts:
✦ You CANNOT make a species based on/with any of my designs without my permission.
I reserve the right to turn any of my designs into a species (excluding custom designs).
✦ You MUST give me credit for the original concept that you have obtained from me.
✦ You MUST agree to allow me to be permanent artist for the species until I decide to resign. (As I may want to make some MYOs and adopts for funsies).COMMERCIAL USE:
✦ You may use the design for commercial purposes (i.e. making merchandise to sell) if you are the current owner and in possession of the character, and have permission from the artist that created the artwork.
✦ You MUST credit me for the design when promoting or sharing merchandise of the design I made.
✦ I do not take any responsibility for deals you, the Client, has made with other artists to use their artwork.

Terms of Use: Bases

✦ I MUST be credited for the base each time you use it!
✦ Anyone on my blacklist or greylist is NOT allowed to own or use any of my bases.✔️Can:
✦ You can use it for personal use.
✦ Make and sell/trade/gift adopts.
✦ Use it to make on-base custom design commissions.
✦ Change/edit the base as much as you like.
✦ Post what you make to any site as long as you credit me for the base.
✦ Print it out and color it traditionally.❌Can't:
✦ Do NOT claim you made the base.
✦ Do NOT remove my watermark.

✦ Do NOT resell or redistribute my bases.
✦ Do NOT use without buying if it is P2U.
✦ Do NOT trace any of my bases unless you have bought it and want to add a personal flare
✦ Do NOT sexualize/add genitalia to my feral bases.You can tag me, I'd love to see what you made. :)
Feel free to request bases for me to make.

Payment

✦ I only accept USD through Paypal only. You are responsible for making currency conversions. I will require an email to send an invoice to.
✦ Invoices are set to expire in 10 days and you are expected to pay the full amount by then unless I am notified about any issues.
✦ I am not responsible for any transaction mistakes made on your part.✦ I will only start working on the commission(s) once I've received 100% of the agreed upon amount up front. No exceptions unless it has been previously discussed.
↳ After which, I will start sketching and the sketch and multiple progress updates will be sent to the Client until the commission is complete.✦ Payment plans are available for large commissions and designs (over $100usd) however it is not preferred.✦ For auctions, only bid if you are sure you are able to pay. If you need to retract a bid, you MUST contact me first. Retracting bids more than 2 times (or ghosting, refusing to pay after winning the auction) will result in a blacklist and the previous bid will be accepted.✦ All purchases are final. Refunds will only be given if I deem that I am unable to work on the commission. In that case a refund will be given depending on how much work I have already done. I will only be able to issue the max amount that won't put me at a loss.
✦ Issuing a charge back will result in you being Blacklisted.
✦ Ghosting will result in a blacklist.
✦ I am not responsible for irresponsible spending,✦ In the event that I prematurely pass away, you accept that a refund is not to be expected and my family is not be harassed for it.

Other Terms

✦ You may take inspiration from my artstyle and artwork, such as poses or how I drew something.
↳ This does not permit tracing under any circumstances! Please do not try to copy my artstyle!✦ Art & Design Theft is not tolerated!
Obvious Tracing, Recolours, Reposts, Selling a design that does not belong to you, Claiming that you created the design, will not be tolerated!
